ATV:《有建設有破壞 分清正邪免被利用》
其實若以下任何一點成立,我都會接受該集節目:
一,亞視為非廣播媒體;二,亞視所在市場開放;三,節目並非使用抽離式的旁述。
香港廣播媒體的言論自由受法律限制,是考慮到政府給予發牌制度上的保護而作的折衷。新聞及資訊節目不能像西方電視台般有政治立場是其中之一個限制。《ATV焦點》活像資訊節目的旁述模式無疑是在玩火,並不值得鼓勵—即使亞視反過來形容建制派為「破壞力量」也是一樣。
更何況亞視已經非首次踩界—不久前它才嘗試過把廣告包裝成資訊節目。
The program would have been acceptable to me had any one of the following been true: 1. ATV is a non-broadcasting media, such as a newspaper, 2. ATV operates in a market with free entry, 3. the program uses a format other than faceless and nameless narration.
By law broadcasters in Hong Kong have limited freedom of speech when it comes to news and informational productions, a compromise made in light of their legally-protected oligopoly status. One of the limitations is they are not suppose to take sides, as Western broadcasters rouginely do. By using a narration format so close to informational productions, “ATV Spotlight” is intentionally playing with fire, which is not something to be encouraged. Put it another way, ATV would be equally unruly had it branded instead the pro-government parties as a destructive force.
It should also be noted that this is not the first time ATV tried pushing the legal boundary—it was not all that long ago that it tried passing an infomercial off as a genuine informational production.
